Article 1: General provisions

These General Terms and Conditions of Sale apply to all sale agreements concluded between Future IT bvba and the Customer.

When placing an order the customer shall expressly accept these General Conditions, whereby the customer agrees to the applicability of these General Conditions, to the exclusion of all other terms and conditions of sale. Supplementary conditions of the customer are excluded, unless Future IT bvba has expressly accepted these in writing in advance. Future IT bvba reserves the right to modify these General Conditions at any time for future orders without informing the customer personally thereof and without the customer being able to claim any compensation whatsoever.

Article 2: Price

All prices are expressed in Euros (€).

For new visitors the price is always stated including VAT and all other levies and taxes that the customer is obliged to pay.

Only after the customer logs in with a VAT number will the prices always be stated excluding VAT. The cookies will remember this for a subsequent visit to the website.

Additional delivery, order, reservation and administrative costs are not included and will be stated separately.

The customer shall pay all orders in advance. No goods will be delivered or ordered until the full purchase price has been paid. The price, including any delivery costs, must therefore be paid in full before delivery. A “distance sale” will only be concluded when an order is handed over to the customer or is sent by e-mail to the e-mail address stated by the customer.

Promotions and special offers are only valid while stocks last. Future IT bvba rejects any liability for consequences of typographical or printing errors in the prices of items, deviations in pictures or interim changes to designs.

Future IT bvba reserves the right to modify orders to reflect the correct applicable price or to unilaterally cancel orders if it turns out that the price indications and/or product descriptions of (a) product(s) and any combined options on the website are stated incorrectly due to a technical or human error.

The stated price only concerns the items as these are literally described. The associated photographs are intended for decorative purposes and may contain elements that are not included in the price.

Article 3: Offer

In spite of the fact that the online information is put together with the greatest care, it is still possible that the information is incomplete, contains material errors, or is not up-to-date. Photos are often provided for decorative purposes but do not necessarily correspond to the technical features of the product.

Obvious errors or mistakes in the offer are not binding. Future IT bvba is only obliged to make best efforts as regards the accuracy and completeness of the offered information.

Future IT bvba is not liable under any circumstances for obvious material errors, typographical or printing errors.

The offer is valid as long as stocks last and can be modified or withdrawn by Future IT bvba at any time.

Future IT bvba cannot be held liable for the unavailability of a product.

Article 4: Online purchases

Orders can only be placed via the online eShop. After filling the shopping basket the customer will choose the shipping arrangements. After this the customer will receive an overview of the total cost including taxes and shipping. The customer can only proceed to payment after accepting the General Terms and Conditions of Sale. Future IT bvba uses the payment module of KBC Bank for this. The offered payment cards are those that are available at that time within this module.

The order will be recorded after receipt of confirmation of payment and Future IT bvba will send an order confirmation to the e-mail address entered by the customer.

Future IT bvba is at all times entitled to refuse an order. In that case, amounts that have been paid will automatically be repaid on the same account as the one used to make the payment.

The customer is aware of the limitations and risks of using the internet or any other medium used to make the website available now or in the future. The customer is also aware of the risks of storing and sending information by digital or electronic means. The customer accepts that Future IT bvba is not liable for any damage due to the use of the Future IT bvba website or the internet as a result of the aforementioned risks.

The customer accepts that electronic communications and back-ups can serve as proof.

Article 5: Delivery and performance of the agreement

The customer can find the stock situation per item before adding the item to the shopping basket. All orders completed on a working day before 17:00, of which all items are in stock , will be delivered FREE of charge on the customer's chosen delivery address in Belgium during the next business day. If the customer chooses a pick-up point, an additional business day will be added and delivery will no longer be free. Different delivery periods apply to foreign deliveries. In the event of delay the customer will be informed as soon as possible.

For items that are not in stock the delivery time will be notified to the customer as soon as this information is available.

The customer must report any visible damage and/or quality defects in an item or other shortcoming in a delivery to Future IT bvba without delay. Complaints regarding deliveries will only be accepted within eight (8) calendar days after the date of delivery.

The risk of loss or damage shall pass to the customer once he (or a third party designated by him, who is not the carrier) has physical possession of the goods.

Article 6: Retention of title

The title to the delivered goods will pass from Future IT bvba to the customer following receipt or handover of the goods to the customer and full payment of the price.

Until the purchase price has been paid it is prohibited for the customer to pledge the goods or to offer or use them as security in any manner whatsoever. It is expressly prohibited for the customer to modify these goods, to render such goods immovable by incorporation or use, sell them or otherwise dispose of them in any manner whatsoever. As long as Future IT bvba, under the provisions of this clause, retains title to the delivered goods, the customer remains liable for maintaining the goods in good condition. During this period the customer is solely liable for any loss of or damage to the goods. The customer undertakes to insure the goods against all risks. The customer also undertakes to arrange the storage of the goods in such a way that any confusion with other goods is excluded at all times and they can always be recognised as the property of Future IT bvba. Any payment by the customer will first reduce the outstanding amounts due for the goods that the customer has modified or sold contrary to this article.

Article 6 only applies in exceptional cases where the order is not placed online and there is no question either of payment with the order.

Article 7: Right of withdrawal

The consumer has the right to notify Future IT bvba that he wishes to cancel the purchase without payment of a penalty and without giving reasons within 14 calendar days from the day following delivery of the item.

The right of withdrawal does not apply to legal entities or to products bought by a natural person for professional use.

To exercise the right of withdrawal the customer must inform Future IT bvba by means of an unambiguous declaration of his decision to cancel the agreement. The customer can make use of the online model cancellation form for this after which the customer will receive a confirmation of receipt by e-mail.

The burden of proof as regards the exercise of the right of withdrawal lies with the customer.

The customer is liable for depreciation in value of the goods as a consequence of any use of the goods that exceeds what is required to determine the nature, features and functioning of the goods.

The right of withdrawal only applies to goods where the accessories, use instructions, invoice and proof of purchase are included.

The right of withdrawal does not apply to the following items:

To comply with the cancellation deadline the customer must send his notification regarding the exercise of the right of withdrawal before the cancellation deadline has expired.

The customer must return the goods without delay, but in any event not later than 14 calendar days after the day on which he has notified Future IT bvba of his decision to cancel the agreement, to Future IT bvba Brusselsesteenweg 386/2, 3020 Herent, Belgium. The customer is on time if he sends back the goods before the 14 calendar day deadline has expired. The right of withdrawal will definitively expire if the goods are sent after the expiry of the 14 calendar days. The customer shall provide the written proof of the dispatch of the goods within 14 calendar days on simple request by Future IT bvba. This proof comprises at least a photo of the returned goods together with the parcel number from the transport company which provides the required traceability.

The customer is responsible for the direct costs of returning the goods.

When the goods arrive Future IT bvba will perform a thorough check on the condition of the goods. The customer accepts that the condition of the goods during the check performed by Future IT bvba is the same as the condition of the goods when these were sent by the customer. If the value of the returned goods has diminished in any way the customer will be informed of this and Future IT bvba reserves the right to hold the customer liable and to claim compensation for any decrease in value of the goods resulting from the use of the goods by the customer that goes beyond what is needed to determine the nature, characteristics and functioning of the goods.

Only items in their original packaging together with all accessories, use instructions, invoice or proof of purchase can be taken back.

If the customer cancels the agreement Future IT bvba will refund the customer all payments, including the standard delivery charges, received from the customer up to that time within a maximum of 14 calendar days after Future IT bvba has received all of the goods back and after Future IT bvba has carried out a thorough check on the condition of the goods and has approved them.

Any additional costs due to the customer choosing a delivery method other than the cheapest standard method offered by Future IT bvba will not be reimbursed.

Future IT bvba will refund the customer using the same payment method which the customer used for the original transaction.

Article 8: Guarantee

Pursuant to the consumer protection law of 21 September 2004 on purchase of consumer goods, the consumer has certain statutory rights. This statutory guarantee starts on the date of delivery to the first owner and is valid for 24 months. Any commercial warranty does not affect these rights.

The customer protection does not apply to purchases by businesses or to goods bought for professional use, in which case only the basic manufacturer’s warranty applies.

To be able to invoke the guarantee, the customer must be able to submit a proof of purchase. Customers are advised to keep the original packaging of the goods. The shipment risk remains with the customer until the goods have reached Future IT bvba.

The faulty item must be returned at the customer’s expense to Future IT bvba Brusselsesteenweg 386/2, 3020 Herent, Belgium.

If he discovers a fault the customer must inform Future IT bvba as soon as possible. In any event any defect must be notified within a time limit of two (2) months after the customer has discovered it. Any right of repair or replacement lapses after that time.

The (commercial and/or statutory) guarantee never applies to defects arising as a result of accidents, neglect, falling, use of the item contrary to its designed purpose, failure to comply with use instructions or manuals, adjustments or modifications to the item, rough use, poor maintenance or any other abnormal or incorrect use, nor external causes, normal maintenance or normal wear and tear. Defects caused by the use of alternative consumables such as refillable ink cartridges are excluded from the guarantee. Batteries are always excluded.

Defects that manifest after a period of six (6) months following the date of purchase or delivery cannot be considered as hidden defects, subject to contrary proof by the customer.

The defective goods must be returned in their original packaging. Damage resulting from improper packaging and damage during return shipment of defective goods are not covered by guarantee.

Future IT bvba cannot be held liable for the loss of data on any data carrier, also as a result of a defect, the replacement of a defective part or any other reason. It is also perfectly possible to return the device in its original factory configuration. The customer is himself responsible for the installation/reinstallation of software and data. The customer is himself responsible for making back-ups before sending back a defective item for repair.

In the event of damage to, theft or loss of goods that are returned for repair, any liability of Future IT bvba as regards the customer is in any event limited to the sale price of the goods.

Article 10: Penalties for non-payment

Notwithstanding the exercise of Future IT bvba's other rights, the customer is liable in the event of non-payment or late payment automatically and without warning to pay interest at 10% on the unpaid amount from the date that the breach of contract commences. Moreover, the customer is liable automatically and without warning to pay fixed-sum compensation of 10% of the amount in question, with a minimum of EUR 25.00 per invoice.

Notwithstanding the foregoing, Future IT bvba reserves the right to take back items that have not been paid in full.

Article 11: Privacy

The data processor, Future IT bvba, complies with the Belgian Personal Data Protection Act of 8 December 1992.

Personal data communicated by the customer shall only be used for the following purposes:

The customer has a legal right to examine and if need be correct personal data. Provided that he can prove his identity (copy of identity card) the customer can by means of a written, dated and signed request sent to info@futureit.be receive his personal data in writing free of charge. If necessary the customer can also ask to correct data that is incorrect, incomplete or irrelevant.

If data is used for direct marketing the customer can object free of charge to the use of such data for direct marketing. The customer can approach info@futureit.be to this end.

Future IT bvba will keep the customer’s data secret and shall not pass it on, hire it out or sell it to third parties.

The customer is himself responsible for keeping his login data and his use of passwords secret.

Future IT bvba keeps (anonymous) online visitor statistics to see how often which pages on its website are visited.

Article 12: Use of cookies

Cookies will be saved on the hard disk of your computer when you visit the Future IT bvba website. A cookie is a text file which a website server places on your computer browser or your mobile device when you consult a website.

Cookies cannot be used to identify persons; a cookie can only identify a machine.

By using our website you agree to our use of cookies.

Article 13: Validity - non-waiver

If a provision in these General Terms and Conditions of Sale is invalid, unlawful or declared null and void, this shall not in any way affect the validity, lawfulness and applicability of the other conditions.

The failure at any time of Future IT bvba to enforce one of the rights summarised in these Terms and Conditions of Sale or any right deriving from these shall never be deemed a waiver of such a provision and shall never affect the validity of those rights.

Article 14: Proof

The customer accepts that electronic communications and back-ups can serve as proof.

Article 15: Jurisdiction and disputes

Belgian law applies to this agreement with the exception of provisions of private international law regarding the applicable law.

The courts of the customer's residence are competent to hear disputes. The customer can also make use of the ODR platform (http://ec.europa.eu/consumers/odr/).

The courts of the legal district of Leuven are competent to hear disputes with regard to traders, in person or in the form of a company.
